These Terms & Conditions apply to your use of the ROC GOLF website and to purchases made through our online store.

By using our website or placing an order with us, you agree to these Terms & Conditions. Please read them carefully before using the website or placing an order.
Nothing in these Terms & Conditions affects your statutory rights as a consumer.
2. USING OUR WEBSITE
You may use our website only for lawful purposes and in accordance with these Terms & Conditions.
You must not:
• use the website for any unlawful or fraudulent purpose;
• attempt to gain unauthorised access to the website or its systems;
• introduce viruses, malware or other harmful or malicious code;
• interfere with the operation or security of the website;
• scrape, copy or systematically extract website content, product information, images or pricing without our written permission;

• use discount codes, promotions or other offers fraudulently or in a way that is not intended by us.

3. PRODUCTS AND PRODUCT INFORMATION
We aim to ensure that product descriptions, photographs, specifications, availability and pricing displayed on our website are accurate and up to date.
However, minor variations may occur. For example, colours may appear differently depending on your device or screen settings, and product packaging may change.
We reserve the right to correct errors, update product information and withdraw products from sale.
Nothing in this section limits your statutory rights in relation to goods that are faulty, not as described, or otherwise do not meet the requirements imposed by applicable law.
4. PRICES
All prices displayed on our website are stated in pounds sterling unless otherwise indicated.
Where applicable, prices will include VAT at the rate required by law.
Delivery charges and any other applicable charges will be shown before you complete your purchase.
We may change our prices at any time. A price change will not affect an order that we have already accepted, except where there has been an obvious pricing or technical error.
If we discover an obvious error in the price of a product after you have placed an order, we may contact you to ask whether you wish to proceed at the correct price. If we cannot contact you, or you do not wish to proceed, we may cancel the order and refund any payment you have made.
5. PLACING AN ORDER
When you place an order through our website, you are making an offer to purchase the relevant products.
After you place an order, we will normally send an acknowledgement confirming that we have received it. This acknowledgement does not necessarily mean that your order has been accepted.
A contract between you and ROC GOLF will normally be formed when we confirm that your order has been accepted, for example by confirming dispatch.
We reserve the right to refuse or cancel an order where there is a legitimate reason, including where:
• a product is unavailable;
• there is an obvious pricing or product-description error;
• we are unable to obtain payment;
• we reasonably suspect fraud or unauthorised activity;
• an order appears to have been placed for unlawful purposes; or
• an order would otherwise require us to act in breach of applicable law.
If we cancel an order after payment has been taken, we will refund the amount paid for the cancelled products.
6. PAYMENT
Payment must be made using the payment methods made available through our website.
You confirm that the payment information you provide is accurate and that you are authorised to use the relevant payment method.
We may use third-party payment providers to process payments securely. Your payment may therefore also be subject to the terms and privacy policies of the relevant payment provider.
7. DELIVERY
We will deliver products to the delivery address provided when you place your order.
Available delivery methods, charges and estimated delivery times will be shown during the checkout process or otherwise communicated to you.
Any delivery dates or times stated by us are estimates unless we expressly state otherwise.
We are not responsible for delays caused by events outside our reasonable control, including carrier delays, severe weather, industrial action, customs delays or other events beyond our control. This does not affect any rights you have under applicable consumer law.
You are responsible for providing an accurate delivery address. If you provide an incorrect address and the goods cannot be delivered or are returned to us, we may need to charge reasonable additional delivery costs where permitted by law.
For consumer purchases, responsibility for the goods will pass to you in accordance with applicable law. Where we are responsible for arranging delivery to you, goods will generally remain our responsibility until they come into your physical possession or the possession of a person you have identified to receive them.
8. RETURNS, CANCELLATIONS AND REFUNDS
Our Returns & Refunds Policy explains how to return products and how refunds are handled.
Where you are a consumer, you may have a legal right to cancel an online order within the applicable cancellation period, subject to the exceptions provided by law.
Nothing in our Returns & Refunds Policy or these Terms & Conditions removes or restricts any statutory rights you have.
Where a product is faulty, damaged, not as described or otherwise does not conform to your legal rights, please contact us as soon as reasonably possible so that we can assist you.
Refunds will be made using the original payment method where reasonably possible and in accordance with applicable law.
9. FAULTY, DAMAGED OR INCORRECT GOODS
If you receive goods that are damaged, faulty, incorrect or not as described, please contact us at robert@rocgolf.co.uk with your order details and, where appropriate, photographs showing the issue.
We will assess the issue and provide an appropriate remedy in accordance with your statutory rights and applicable law.
Depending on the circumstances, this may include repair, replacement, refund or another remedy available under applicable law.
We may ask you to provide reasonable information or evidence to help us identify the issue. This does not affect your statutory rights.
10. CUSTOMISED OR PERSONALISED PRODUCTS
Where products are made to your specifications or personalised at your request, cancellation and return rights may be affected where an applicable legal exception applies.
We will identify any such restriction before you place the relevant order where required by law.
Nothing in this section affects your rights where a personalised or customised product is faulty, defective or otherwise does not conform to the contract.

All intellectual property rights in our website and its content, including the ROC GOLF name and branding, logos, photographs, graphics, product descriptions, text, designs and other materials, belong to ROC GOLF or our licensors unless otherwise stated.

We may remove User Content where we reasonably believe it breaches these Terms & Conditions or applicable law.

We are not responsible for the content, security, availability or practices of third-party websites or services that we do not control.

We will not be responsible for failure or delay in performing our obligations where the failure or delay results from an event outside our reasonable control.

If you are a consumer, nothing in these Terms & Conditions limits any rights you have under applicable consumer protection law.
23. GOVERNING LAW AND JURISDICTION
If you are a consumer, these Terms & Conditions are governed by the laws applicable to you, and nothing in these Terms & Conditions prevents you from relying on mandatory consumer protection rights available in your country or from bringing proceedings in a court where applicable law allows you to do so.
For customers resident in Northern Ireland, these Terms & Conditions are governed by the law of Northern Ireland.
If you are purchasing from us in the course of a business, these Terms & Conditions are governed by the law of Northern Ireland and, subject to applicable law, the courts of Northern Ireland will have jurisdiction over disputes arising from these Terms & Conditions.
